Services
Avisey offers creative services including but not limited to branding, graphic design, and social content creation. The scope of work for each project will be detailed in a separate agreement, quotation, or briefing.
Quotations and Agreements
All quotations are non-binding and valid for 14 days unless otherwise stated. An agreement is established only after written acceptance by the client and confirmation by Avisey. Any changes to the agreed scope must be mutually confirmed in writing and may result in additional charges or delivery time adjustments.
Payments
Invoices are payable within 14 calendar days from the invoice date. In case of late payment, statutory interest (wettelijke rente) and reasonable collection costs may be charged. Avisey reserves the right to suspend services or withhold final delivery until full payment is received.
Intellectual Property
All work created by Avisey remains the property of Avisey until full payment has been received. Upon payment, usage rights are transferred as agreed in writing, but copyright remains with Avisey unless otherwise specified.
Unless otherwise agreed, Avisey reserves the right to use delivered work for promotional purposes, such as portfolio, website, or social media.
Liability
Avisey undertakes to perform all services to the best of its ability and with due care, skill, and professionalism.
However, results may vary depending on third-party factors such as client responsiveness, platform algorithms (e.g. Instagram, TikTok), software bugs, or market behavior. Therefore, Avisey cannot guarantee specific results, such as increased visibility, engagement, or revenue.
Avisey is only liable for direct damages caused by demonstrable intent or gross negligence. Liability is strictly limited to the amount invoiced for the relevant service.
Avisey is never liable for:
- indirect, incidental, or consequential damages;
- loss of profits, savings, data, or business opportunities;
- reputational damage;
- third-party claims related to content, delays, or performance;
- damage caused by external services, software, or platforms used in the process.
Clients are responsible for providing accurate and complete materials, information, and instructions. Avisey is not liable for delays or errors resulting from incomplete or inaccurate input.
The client indemnifies Avisey against any third-party claims or damages arising from the use of materials supplied by the client.
Any liability claim must be submitted in writing within 30 days of discovery. After this term, all rights to claim expire.
Termination clause
Either party may terminate the agreement in writing if the other party fails to fulfill its obligations and does not resolve the issue within 14 days after written notice. Work already delivered will be invoiced proportionally.
Governing Law
These terms are governed by Dutch law. Disputes will be settled in the competent court in Haarlem.
